| California Legislature on verge to pass new DUI AB-1601 |

| AB-1601 will amend the DUI laws that allow DUI convictions to be on your record for life rather then the current 10 years. Presently if you have a DUI conviction it stays on your record for 10 years as a priorable offense. Previously the legislature increased the term of use of prior DUI convictions from 5 to 7 and 10 years which allow a current offense to be enhanced for license suspensions and other penalties. AB-1601 would allow any prior DUI conviction to stay on a driver's record for life. Allowing multiple offenses to be charged no matter how old they may be rather than the 10 year limitation presently set. Thebill would also require a 90 day jail sentence for a second time DUI rather than the 96 hours minimum under the current law. |

| GOOD NEW FOR MULTIPLE DUI OFFENDERS |

Starting July 1st, the California Legislature has given drivers with two and three DUI Convictions a break allowing them to get a restricted drivers license after a 90 day suspension for a 2nd offender, and after a 6 month suspension for a third DUI.
The California legislature enacted new rules for those convicted of multiple DUI offenses.. AFTER JULY 1st
Then old rule allowed a person convicted of a 2nd DUI to get a restricted license (to and from work, work related and alcohol program after serving a year on a 18 month suspension.
The new law allows a 2nd offender to get to get the restricted license after a 90 suspension. The driver MUST have an SR-22 proof of insurance, be enrolled in the SB-38 multiple offender alcohol program, and have an IID (ignition interlock device installed.
The third time offender can now get his restricted licensed after serving 6 months of the 3 year revocation imposed by the DMV.
The DMV is threatening NOT to implement the new rules, claiming that the original suspension MUST be served before any retracted license may be issued. |

CHP reports that DUI arrests are up 30% over the holiday period ending December 31st

| 30 Million Dollars from Fed and 8 Million from State for DUI Checkpoints |

The Sacramento Bee reported that 30 Million in Federal Funds and 8 Million in State funds became avialable to 150 California Cities to increase DUI chekpints in 2010 by 50%

To boster the claim of need to line cops pockets with easy overtime pay duty, NHTSA misleading statistics are quoted . The claim of alcohol related and alcohol involved accidents are used to pad the accident statistics. Thses terms do not mean that the driver used alcohol, was over the legal limit, or impaired. They include alsohol levels as low as .01%, passengers that had alcohol and not the driver, and accidents caused by an alcohol free driver but who caused a crash and the innocent vrash victem may have had some alcohol.
