Description Client charged with second DUI. Prior was out of state New Mexico. High Blood alcohol level of .26 with an accident mid day lunchtime. City Attorney wanted 30 days custody 18 month alcohol program and 18 month Ignition Interlock IID . I challenged the prior and City Attorney had to dismiss the allegation. I suggested to client to do a bench (judge) trial as the City Attorney did not charge the BAC properly. The idea was to receive a better sentence at end of trial. Anticipated a guilty verdict. Judge agreed with defense that the high (over .20) was not charged properly. Sentenced to 10PWS and 9 month alcohol program with standard teams. NO IID, NO 30 days custody. NO reporting to DMV of .20 or higher BAC .
